In
Tennessee, a Notary Public is a public officer elected by the
county legislature and then commissioned by the Governor to act as an
impartial witness in taking acknowledgments, administering oaths and
affirmations, and performing other acts authorized by state law.
Notaries serve the public by certifying that certain events did take
place -- the person who signed the document did acknowledge signing it,
or they did swear that the statements made in the document are true --
as well as verifying that proper identification of the signer was
presented.
The most frequent official acts a notary public is requested to perform are the taking of affidavits and acknowledgments. An affidavit is a sworn statement made by a person called an affiant. The affiant makes oath before a notary public that the facts contained in the affidavit are true. An acknowledgment, as its name implies, is a declaration by a person who has executed or signed a deed or other document, that he or she has in fact executed such document.
What is a "Traveling Notary Public" or "Mobile Notary"?
A Traveling Notary Public or Mobile Notary is a Notary who goes to where the signer is, rather than requiring the signer to come to them. What is a Notary Signing Agent?
A Notary Signing Agent is a Notary Public who has special expertise to conduct loan signings. The Signing Agent is hired as an independent contractor by a title, mortgage, or escrow company, a lender, or a signing service to ensure that the loan signing process is properly completed.
The Signing Agent receives the documents from his or her client, takes them to the borrowers, assists the borrower with signing, notarizes certain documents, and quickly returns the loan package for processing ("closing").
In the past, whenever a lender did not have an office near the location where the loan signing was to take place, they would contract with title companies or attorneys, which was expensive and often inconvenient for the borrowers. Now, innovations in technology, stiff competition in the lending market, a corporate trend toward out-sourcing, and the increasingly-busy lives of consumers have led lenders to hire Notary Signing Agents. People buying homes (or refinancing) can now enjoy the benefits of Notary Signing Agents coming to them, at their convenience, which saves them time and money on their loan process.
